Specialized State Bar Approved Professional Development Activities For Construction Defect Attorneys
Leveraging from the experience gained through expert designations in more than 3500 construction defect and claims related litigations, Bert L. Howe & Associates, Inc. provides clients with a series of approved CEU/MCLE activities geared to the specific needs of legal professionals, builders, insurers and construction practice groups.
The Experts Group has developed a number of approved activities designed specifically for the insurance professional, covering all aspects of residential and commercial construction. Defense attorneys, insurance adjusters, paralegals and insurance underwriters will all benefit from the valuable information on claims avoidance, construction claims cost mitigation, successful documentation in support of third party claims, subrogation, and understanding the methods/standards employed in visual and destructive site inspections.

Most activities can be accessed through scheduling a webinar. BHA webinars facilitate access to BHA learning activities through user friendly web conferencing capabilities, enabling our clients’ regional and satellite offices to participate in the activity without leaving their desk. Through more than 15 years of providing these services, BHA has developed a wide array of presentation assets, which are tailored to suit each client’s special requirements. Each activity is supported by extensive animated and fully rendered multimedia assets designed to visually impart understanding of complex construction mechanisms and systems often found at the heart of construction defect and related claims.
Employing a collegial workshop atmosphere in connection with visual resources encourages interaction between attendees and dialog with presenters. Questions and answers are encouraged throughout the activity. Each activity concludes with a workshop section wherein attendees have an opportunity to discuss issues or ask questions specific to their caseload or individual needs. Construction Defect and Claims Cost Mitigation
Multimedia supported in-house lecture activity, contemporary issues and advancements in construction defect claims, with specialized
emphasis allocation and liability apportionment in support of third party claims. Structural and foundation systems as well as fenestrations, roof, deck and building envelope systems are discussed from the construction claims and liability perspectives.
Attendees will gain from an explained visual understanding of the most common issues associated with residential construction defect claims. Substantive handout material will provide attendees with an continued benefit through full color reference works that visually explain expert opinions/issues frequently encountered in connection with the interested (third party) sub trades related to each issue.

Understanding Construction Defect Litigation
Animation supported in-house lecture with focus on the residential construction process, construction sequencing, and the inter-relationships between the developer, general contractor, sub trades and design professionals. Typical plaintiff HOA expert issues are examined in connection with primary building systems and components frequently associated with construction defect and claims litigation.
In the dynamic environment of construction defect litigation, ongoing education with regard to construction terminology and technology is vital to the efficient management of construction-related claims. Attendance at the Construction Defect and Claims Cost Mitigation Seminar will provide the attendee with a greater understanding of the terms and conditions encountered on a daily basis, and will at the same time assist in the satisfaction of important MCLE requirements.
This activity will provide you with one hour of participatory credit through attendance at an approved lecture or in-house education. Because this activity is limited to one hour, and in an effort to make attendance as easy as possible, no materials need be reviewed prior to attendance (although seminar outlines and attendant handout will be provided at the time of presentation).

Construction Basics
This seminar provides an overview of the construction process from land selection and preparation through foundation placement, framing, roofing, and interior and exterior finish installation. Perfect for both the seasoned CD professional as well as the industry newcomer, Construction Basics offers a comprehensive introduction to residential construction.
Concrete, Slabs on Grade and Foundation Systems
This seminar provides an overview of concrete materials and methods, with an emphasis on concrete slabs on grade, concrete foundation systems, concrete reinforcing materials and admixtures. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
General Framing
With a strong focus on residential Type-V construction, this seminar takes the attendee on an exploration of framing terminology and materials, highlighting framing connections, hardware, interfaces with foundations and other building elements, and structural components including shear-resisting assemblies. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
Windows and Doors
Water intrusion through window and door assemblies accounts for a significant portion of a typical CD claim. This seminar introduces window and door products, fenestration installation including framing and flashing materials, and integration with surrounding interior and exterior finishes. Window and door types are discussed (horizontal slider, single hung, fixed sash, etc.) as are the various materials utilized in window and door manufacture. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
Roofing and Waterproofing
After doors and windows, roofing and roofing-related conditions account for most of the water intrusion allegations seen today on construction defect litigation. This seminar investigates roofing materials, sheet metal flashing components, roofing underlayment, as well as roof framing and roof sheathing and the interface of the roof with adjacent building finishes and veneers. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
Exterior Finish Systems
This seminar explores the often confusing world of stucco systems, EIFS, wood and composite siding, brick and stone veneer, elastomeric paints, caulking and other sealants. Similarities and differences between common exterior finishes are addressed and discussed, as are recent changes and developments in exterior finish systems. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
Site, Grading, and Drainage
Principles of grading, drainage mechanisms. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
Bathrooms and Ceramic Tile
Tub and shower assemblies, ceramic tile surrounds and shower receptors, shower enclosures, waterproof membranes. Typical allegations raised by homeowner/HOA experts are addressed as is identification of potential contributing subcontractors by trade and scope.
